How much is the tax stamp on a suppressor in 2026?
Zero dollars. The One Big Beautiful Bill Act, signed July 4, 2025, lowered the National Firearms Act transfer and making tax on suppressors, short-barreled rifles, short-barreled shotguns and “any other weapons” (AOWs) to $0, effective January 1, 2026. The transfer tax is set in 26 U.S.C. 5811.
Before 2026, a suppressor cost $200 in federal tax on top of the price of the can. That amount was set in 1934 and never adjusted for inflation.
Which NFA items still cost $200?
| NFA item | Tax before 2026 | Tax from Jan 1, 2026 |
|---|---|---|
| Suppressor (silencer) | $200 | $0 |
| Short-barreled rifle (SBR) | $200 | $0 |
| Short-barreled shotgun (SBS) | $200 | $0 |
| AOW | $5 transfer / $200 making | $0 |
| Machine gun | $200 | $200 |
| Destructive device | $200 | $200 |
Did the $0 tax stamp get rid of the Form 4?
Not by itself. Because the change came through a budget reconciliation bill, Congress changed only the tax, not the registration rules. From January through mid-August 2026 buyers still filed a Form 4, submitted fingerprints and a photo, and waited for ATF approval. The stamp was simply free.
That set up a lawsuit. Gun rights groups argued that the NFA’s registration rules were justified as a way to collect a tax, so with no tax left, the registration requirement had no constitutional footing.
The August 2026 ruling and what it means for your stamp
On August 5, 2026, Judge James Wesley Hendrix of the Northern District of Texas agreed in Silencer Shop Foundation v. ATF, consolidated with Jensen v. ATF. He enjoined enforcement of NFA registration and approval for suppressors, SBRs, SBSs and (for the Silencer Shop Foundation plaintiffs) AOWs. The injunction took effect August 13, 2026.
It covers the plaintiffs, their members and their customers, not everyone. Indiana is a plaintiff state. Silencer Shop now says suppressors and AOWs that come from Silencer Shop and are bought in 27 free states, including Indiana, transfer on a Form 4473 with a NICS check. No tax stamp paperwork to wait on.
Silencer Shop still processes SBRs and SBSs on a Form 4 (with the $0 stamp), and it adds the $0 stamp to eligible orders automatically. It does not sell stamps for machine guns or destructive devices.

Do I still need a tax stamp for a suppressor?
It depends on how you buy it:
- Covered Silencer Shop purchase in Indiana: 4473 and background check. No Form 4 filing.
- Suppressor from a source that isn’t covered: may still need a Form 4, which comes with the $0 stamp.
- Suppressor you already own: it stays on the NFA registry. Keep your approved Form 4 with your records.
- Buyers in NFA-process states: state law may still require the federal NFA process.
Is the $0 stamp permanent?
The $0 tax is in federal statute, so changing it back would take another act of Congress. The registration relief is different: it comes from a court injunction that protects specific parties, and courts or agencies can revisit it. The $0 tax and the 4473 process are two separate changes, and only the first one applies to everyone.
What about AOWs?
“Any other weapons” are a catch-all NFA category that includes items like certain disguised guns and some smooth-bore pistols. Their tax is also $0, and Silencer Shop handles covered AOWs from its network the same way as suppressors in free states: a 4473 and a NICS check.
Can I get a refund on a $200 stamp I paid before 2026?
We haven’t found any refund program for taxes paid before January 1, 2026, and the law change was not written as retroactive. If you’re unsure, ask a tax professional.
What does a suppressor cost now?
With the tax gone, your cost is the price of the suppressor plus any dealer or transfer fees. At Condition Red Tactical, the in-store Silencer Shop kiosk is free when you buy through Silencer Shop. A covered 4473 purchase may not need the kiosk at all. If you bought an NFA item elsewhere and ship it to us, the transfer fee is $50. Browse options on our suppressors page.

Common Questions
When did the suppressor tax stamp become $0?
January 1, 2026, under the One Big Beautiful Bill Act.
Is the machine gun tax stamp still $200?
Yes. Machine guns and destructive devices still carry the $200 NFA tax.
If the tax is $0, why did people still file a Form 4 in early 2026?
The tax law only changed the dollar amount. Registration ended for covered buyers only after the August 2026 court ruling took effect on August 13.
Do I still get a physical tax stamp?
For items still processed on a Form 4, ATF approval still issues with a $0 stamp. For covered 4473 suppressor purchases, there is no Form 4 or stamp to wait for.
