Buy a Suppressor on a 4473 in Indiana: 2026 Guide

Can you buy a suppressor on a 4473 in Indiana?

For many buyers, yes. On August 5, 2026, Judge James Wesley Hendrix of the U.S. District Court for the Northern District of Texas ruled in Silencer Shop Foundation v. ATF (consolidated with Jensen v. ATF) that the National Firearms Act’s registration and approval requirements can’t be enforced for suppressors, short-barreled rifles, short-barreled shotguns and AOWs now that Congress has set their tax to $0. The injunction took effect August 13, 2026.

The key detail: the order protects the parties to the case, their members and their customers. It is not a blanket change for everyone in the country. Silencer Shop is a plaintiff, and Indiana is one of the plaintiff states. Silencer Shop says that suppressors (and AOWs) that originate from Silencer Shop and are bought in one of 27 “free states,” Indiana included, now transfer like an ordinary firearm: a Form 4473 and a NICS background check at the dealer.

Who is covered at a Powered by Silencer Shop dealer

According to Silencer Shop’s ruling FAQ, you are covered for the 4473 process if all of these are true:

  • The suppressor originates from Silencer Shop, either ordered online or sold through a Powered by Silencer Shop dealer.
  • You are buying in a free state. Indiana is on that list.
  • You can legally buy a firearm from a dealer and you pass the background check.

Silencer Shop says its customers do not need a separate membership to be covered. It also says each dealer decides which process it uses, so some shops in free states may still choose to run a Form 4.

What to bring when you pick up a suppressor on a 4473

  • A valid Indiana driver’s license or state ID with your current address. If your ID shows an old address, bring it up before you come in.
  • You must be at least 21. Federal law treats a suppressor as a firearm that isn’t a rifle or shotgun, so dealers can’t sell one to anyone under 21.
  • Time to fill out the 4473. It’s the same form you complete for a rifle or handgun. We use an electronic background check system.

Under the 4473 process, Silencer Shop says there is no Form 4, no fingerprint submission, no passport photo and no ATF wait. If the background check proceeds, you can typically take the suppressor home the same day.

Form 4 vs 4473: what changed and what didn’t

Item How Silencer Shop processes it in Indiana (as of Sept 2026)
Suppressor from Silencer Shop Form 4473 plus NICS check
AOW from Silencer Shop Form 4473 plus NICS check
Short-barreled rifle (SBR) Form 4 still required
Short-barreled shotgun (SBS) Form 4 still required
Suppressor from another source May still need a Form 4 unless you are otherwise covered
Machine gun or destructive device Unchanged. $200 tax and full NFA process

Why SBRs and SBSs still need a Form 4

The ruling covers SBRs and SBSs too, but Silencer Shop still requires a Form 4 for them. Its FAQ explains that the Form 4 is currently the only form ATF makes available for approving a dealer’s transfer of an SBR or SBS. A separate federal law, 18 U.S.C. 922(b)(4), limits dealer sales of those items to transfers the government has authorized. So if you want a short-barreled rifle or shotgun, expect the Form 4 route for now. Our SBR and SBS rules guide covers this.

What if your suppressor didn’t come through Silencer Shop?

This is where people get tripped up. The injunction covers the named plaintiffs, their members and their customers. A suppressor bought from a company that isn’t part of the case, or shipped from a distributor that isn’t covered, may still need the full Form 4 process. Some buyers may be covered another way, for example as members of a plaintiff organization, but the dealer still decides how it will process the transfer.

If you bought a suppressor somewhere else and want it shipped to us, we handle NFA transfers for items not bought through CRT for $50. We’ll tell you up front which paperwork it needs. See our FFL transfers page for details.

What about the tax stamp?

The One Big Beautiful Bill Act cut the NFA tax on suppressors, SBRs, SBSs and AOWs to $0 starting January 1, 2026. Machine guns and destructive devices still carry the $200 tax. Silencer Shop adds the $0 stamp to eligible orders automatically. More in our tax stamp guide.

Could this change?

Yes. News reports on September 17 and 18, 2026 said the Justice Department won’t appeal, but courts, Congress and ATF can all change the picture. The ruling also doesn’t override state law: 15 states still require the NFA process under their own laws, and several states ban suppressors outright. If you move out of Indiana, check the new state’s rules before you take the suppressor with you. Keep your receipt and 4473 record, and ask us if anything is unclear.
