SBR and SBS Rules in 2026: $0 Stamp, Still a Form 4

Updated October 17, 2026 · By the team at Condition Red Tactical, Greenfield, IN

What counts as an SBR or SBS?

Under 26 U.S.C. 5845 and 18 U.S.C. 921:

  • Short-barreled rifle (SBR): a rifle with a barrel under 16 inches, or an overall length under 26 inches, or a weapon made from a rifle that ends up that short.
  • Short-barreled shotgun (SBS): a shotgun with a barrel under 18 inches, or an overall length under 26 inches, or a weapon made from a shotgun that ends up that short.

Barrels are measured from the closed bolt face to the muzzle. A permanently attached muzzle device counts toward length; one that just screws on does not.

Yes, when you comply with federal law. Indiana repealed its state ban on sawed-off shotguns, former IC 35-47-5-4.1, through Senate Bill 433 of 2015, effective July 1, 2015. Indiana doesn’t have a separate state ban on short-barreled rifles. The same 2015 law added a sentence enhancement for possessing a sawed-off shotgun in violation of federal law while committing certain offenses, so federal compliance still matters under state law.

What changed for SBRs in 2026

The tax is $0. The One Big Beautiful Bill Act dropped the NFA making and transfer tax on SBRs and SBSs from $200 to $0, effective January 1, 2026.

The court ruling. On August 5, 2026, Judge James Wesley Hendrix ruled in Silencer Shop Foundation v. ATF (consolidated with Jensen v. ATF) that NFA registration and approval can’t be enforced for suppressors, SBRs, SBSs and AOWs once the tax is $0. The injunction took effect August 13, 2026 and protects the plaintiffs, their members and customers. Indiana is a plaintiff state.

Why SBRs and SBSs still need a Form 4

Even though the ruling covers SBRs and SBSs, Silencer Shop still requires a Form 4 for them in every state. The reason is a separate law. 18 U.S.C. 922(b)(4), part of the Gun Control Act, bars dealers from selling an SBR or SBS unless the transfer has been specifically authorized. NRA-ILA notes that this restriction was not enjoined. Silencer Shop says the Form 4 is currently the only form ATF makes available for that authorization.

So in 2026, a dealer purchase of an SBR or SBS in Indiana still means:

  1. A Form 4, submitted with fingerprints and a photo (Silencer Shop kiosks capture digital prints).
  2. A $0 tax stamp.
  3. Waiting for ATF approval before pickup.

Building your own SBR on a Form 1

If you want to put a short barrel on a rifle you already own, the traditional route is ATF Form 1, the application to make an NFA firearm, which you must have approved before you build. The making tax is now $0. How the August ruling applies to self-built SBRs for covered parties is still being worked out, and the advice varies. Until the path is clear, don’t cut, swap or assemble anything into SBR configuration without an approved Form 1 or clear confirmation that you’re covered. Our gunsmiths can do the barrel change ($50 labor) once your paperwork is in order; see services.

Traveling across state lines with an SBR

Federal law, 18 U.S.C. 922(a)(4), has required owners to get ATF approval (Form 5320.20) before moving an SBR or SBS across state lines. NRA-ILA lists interstate transportation authorization among the requirements the ruling did not enjoin. Suppressors are not on that list in 922(a)(4). Other states may also have their own SBR or SBS bans, so check before you travel.

Pistol braces and “almost SBRs”

Brace rules have changed repeatedly in recent years and have their own litigation history. We don’t cover them here. If you have a braced pistol, check current ATF guidance or ask us before modifying it.

Buying an SBR or SBS through CRT

We’re a Powered by Silencer Shop dealer with an in-store kiosk, free to use with Silencer Shop purchases. If you bought an NFA item elsewhere and want it transferred through us, the fee is $50; see FFL transfers.

Common Questions

Is the SBR tax stamp free in 2026?

Yes. The NFA tax on SBRs and SBSs has been $0 since January 1, 2026.

Can I buy an SBR on a 4473 after the ruling?

Not through Silencer Shop right now. It still requires a Form 4 because a separate law, 18 U.S.C. 922(b)(4), limits dealer sales of SBRs and SBSs.

Are sawed-off shotguns legal in Indiana?

Yes, if you follow federal law. Indiana repealed its state ban effective July 1, 2015.

What barrel length makes a rifle an SBR?

Under 16 inches, or an overall length under 26 inches. For shotguns the barrel threshold is 18 inches.
