Terms of Service

These Terms of Service (“Terms”) apply to crtguns.com (the “Site”) and to purchases, FFL transfers, gunsmithing and other services from Condition Red Tactical LLC (“Condition Red Tactical,” “we,” “us”), 866 S State St, Greenfield, Indiana 46140. By using the Site, placing an order, or using our services, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can buy

  • You must be at least 18 years old to use our online store, and old enough under federal, state and local law to buy each item you order. Federal law does not allow a licensed dealer to sell a handgun, or ammunition for a handgun, to anyone under 21, or a rifle or shotgun, or its ammunition, to anyone under 18.
  • You must be legally allowed to buy and possess the items you order where you live. You are responsible for knowing and following the laws that apply to you. We may cancel any order we believe would break the law, including orders for items that are restricted in your state or city.

2. Buying firearms

  • Firearms are never shipped to your home. At checkout you choose a federally licensed dealer (FFL) near you, and we ship the firearm to that dealer. Your dealer may charge their own transfer fee. You complete ATF Form 4473 and a background check with your dealer before you take the firearm home.
  • You can also choose to pick up in our Greenfield store, where you complete ATF Form 4473 and the background check at the counter.
  • If we cannot confirm your chosen dealer’s license, or the dealer will not accept the transfer, we will contact you to choose another dealer or cancel and refund the order.
  • NFA items (for example suppressors and short-barreled rifles) require ATF approval before they can be transferred to you. We will explain the process for each order; approval times are set by the ATF, not by us.

3. Product information

Product descriptions and specifications on the Site are computer generated from manufacturer and distributor information and may contain errors. Photos may be manufacturer or stock images and may not show the exact item, finish or accessories. Please confirm the details of the UPC you are purchasing with the manufacturer before you buy. Condition Red Tactical is not responsible for errors in product information. Used firearms are described as accurately as we can; their photos show the actual item.

4. Prices and availability

  • Many items ship directly from our distributors, and their stock and prices change often. An item shown as available may sell out before your order is processed. If it does, we will tell you and refund you for anything we cannot supply.
  • If an item is listed at an incorrect price, we may cancel the order and refund you, even after you have received an order confirmation.
  • Indiana sales tax and any other applicable taxes are added at checkout.

5. Payment

We accept major credit and debit cards through our payment processor. Your card is charged when you place your order. Card details are entered on the processor’s secure form and are not stored by us. Invoices for transfers, repairs and other services can be paid online with the link we email you, or in our store.

6. Shipping

  • Orders ship from our store or directly from our distributors. Delivery dates are estimates and are not guaranteed.
  • Ammunition and other hazardous materials can only ship by ground, and some items cannot ship to some states or addresses.
  • If a package arrives damaged, please contact us within 48 hours of delivery with photos so we can file a claim with the carrier.

7. Returns, cancellations and refunds

  • You can cancel an order at no cost before it ships. After it ships, the return rules below apply.
  • Unused non-firearm items in their original packaging may be returned within 30 days of delivery for a refund of the item price. Return shipping is paid by you unless we sent the wrong item or it arrived damaged.
  • Firearm sales are final once the firearm has been transferred to you, except where the law requires otherwise. Manufacturer warranties still apply, and we are glad to help you use them.
  • For safety reasons, ammunition cannot be returned.
  • If you are not able to complete the background check, or your dealer refuses the transfer, we will help arrange the firearm’s return to us. Return shipping and any dealer fees are your responsibility. A restocking fee of up to 15% may apply.
  • Refunds go back to the original payment method.

8. FFL transfers

  • When you have a firearm shipped to us from another seller, our transfer fee is $35 for the first firearm and $25 for each additional firearm in the same transfer. Suppressors and other NFA items bought elsewhere are charged at the same rate. Machine guns and destructive devices are $50 each. Private-party transfers are $35.
  • Transfer fees are due before the firearm is released and can be paid online with the link we email you.
  • You must complete ATF Form 4473 and pass a background check before we can release a firearm. If you cannot complete the transfer, the transfer fee is not refunded. Returning the firearm to the seller is at your cost.
  • Firearms left more than 30 days after we notify you that they are ready are charged a storage fee of $35 per month. Firearms not picked up within 120 days of that notice may be forfeited, as described in section 11.
  • We send status emails and a private status link for each transfer. Anyone who has the link can see the status page, so please do not share it.

9. Gunsmithing and repairs

  • We give you a written estimate when you leave an item, which you sign. We will not do work that costs more than the estimate without your approval.
  • Items are released to the person named on the claim check, with photo ID. A firearm may only be released to someone legally allowed to receive it.
  • Repaired items left more than 30 days after we notify you that they are ready are charged a storage fee of $35 per month. Items not picked up within 120 days of that notice may be forfeited, as described in section 11.

10. Pre-orders, estimates and “customer wants”

  • Pre-orders may require a deposit, which is applied to the final price. A deposit is refundable if you ask for the refund within 10 days of cancelling, or within 10 days of our notice that the item was not picked up. After those 10 days, deposits are not refundable.
  • Ordered items left more than 30 days after we notify you that they are ready are charged a storage fee of $35 per month, and may be forfeited after 120 days, as described in section 11.
  • Estimates show the prices we can offer on the date given. After that date, prices and availability may change.
  • If you sign an agreement to buy an item when we find it (“customer want”), you agree to buy it at the price and within the time shown in that agreement. We may order it without contacting you again.

11. Items not picked up

For transfers, repairs, pre-orders and anything else we are holding for you: once we notify you that an item is ready, you have 30 days to pick it up at no charge. After 30 days, a storage fee of $35 per month applies, and the item will not be released until the storage fee and any other balance are paid. If an item is not picked up within 120 days of our notice, and we have made reasonable attempts to contact you, the item may be forfeited to Condition Red Tactical to the extent the law allows. A forfeited firearm is handled and recorded as federal law requires. Any deposit or payment already made may be applied to the storage fees and other amounts owed.

12. Accounts

You are responsible for keeping your account login secure and for activity under your account. Tell us right away if you think your account has been used without your permission.

13. Using the Site

Content on the Site, including text, photos, logos and guides, belongs to Condition Red Tactical or its licensors and may not be copied for commercial use without permission. Do not misuse the Site, try to get into areas you aren’t allowed to access, or interfere with its operation. Educational guides on the Site are general information, not legal advice; check the current law for your situation.

14. Disclaimers and limits of liability

The Site and its content are provided “as is.” To the fullest extent the law allows, we disclaim all warranties, express or implied, except those we give in writing and manufacturer warranties. We are not liable for indirect, incidental or consequential damages. Our total liability for any claim relating to an order or service will not exceed the amount you paid for it. You are responsible for the safe and lawful use of everything you buy from us.

15. Indemnity

You agree to defend and indemnify Condition Red Tactical against claims arising from your misuse of the Site or of products you buy, or from your violation of these Terms or of the law.

16. Governing law

These Terms are governed by the laws of the State of Indiana. Any dispute will be handled in the state or federal courts serving Hancock County, Indiana.

17. Changes

We may update these Terms from time to time. The version on the Site when you place an order applies to that order.
